IMPORTANT NOTICE TO PCF MEMBERS & AGENTS
The South Carolina Legislature passed House Bill H 3760 during this past legislative session. This bill merges the South Carolina Patients’ Compensation Fund (PCF) with the South Carolina Joint Underwriting Association (JUA) into a new organization to be called The South Carolina Medical Malpractice Association (SCMMA). Effective 1/1/20, all “existing contractual obligations” of the PCF will become the responsibility of the SCMMA, and the PCF will begin “winding down its affairs.” S.C. Code Ann. § 38-79-300(B). The PCF will continue to renew and receive quotes for new members through 12/31/2019. All renewals with the effective dates of 1/1/2020 and later will be the responsibility of the new entity.
Once the merger takes place, the billing process will be changed. Annual Renewals that are effective January 1, 2020 and going forward will generate a single invoice. If your annual renewal is before January 1, 2020 you will be billed as you are currently being billed and you will still have the option to pay quarterly.
PCF Claims will continue to be handled by the PCF staff through 12/31/2019. The SCMMA will assume the claims handling beginning January 1, 2020.
The Governor is in the process of appointing the Board that will govern SCMMA. Once the Board is appointed, we will have more information to share. The PCF will continue to function as it always has and will continue to provide the same high level of customer service until the merger.
